You accept these T&C and agree to be bound by them by using our services. You are not permitted to use our Services if you disagree with these terms.

- “User,” “you,” or “your” refers to any individual or entity using our Services.
- “Account” refers to the registered account created by the User on our platform.
- “Services” include online store creation, QR solutions, hyperlocal services, ONDC integration, and any other related services provided by LocaleKart.
Content and Intellectual Property
Ownership of Content:
All content, trademarks, logos, and intellectual property displayed on our platform are owned by or licensed to LocaleKart. You may not use any content without our prior written consent.
User Content:
You retain ownership of any content you upload to our platform. By submitting content, you grant LocaleKart a non-exclusive, worldwide, royalty-free license to use, modify, and display your content in connection with our Services.
License to Use:
You are granted a limited, non-transferable, non-exclusive license to access and use our Services for your personal or business use, subject to these T&C.
Buyer-Seller Interactions and Transactions:
Localekart platform enables transactions between Buyers and Sellers. LocaleKart is not and cannot be a party to or control any transaction between the Platform’s Users. Therefore
- Buyers and Sellers alone offer and agree to all commercial and contractual conditions. Price, shipping charges, payment terms, payment methods, delivery date, time, and mode, product and service warranties, and after-sales services are only a few examples of these terms. LocaleKart has no influence over or participation in the offering or acceptance of these conditions by Sellers and Buyers. LocaleKart does not provide any discounts or offers, including exchange offers,; instead, the Seller/Brand does.
- When a customer places an order with a seller on the platform, the seller receives an offer to acquire a product or products. This does not imply that the Seller has accepted the offer made by the Buyer. If the Seller, at its sole discretion, chooses to cancel any order, the Buyer will be notified via email or SMS. In the event that the vendor cancels an order, the buyer will receive a refund for any transaction fees. Additionally, the Seller reserves the right to cancel orders that exceed the average individual consumption based on a variety of factors and at its sole discretion.
- Regarding the details (quality, value, salability, etc.) of the goods or services that are suggested to be bought or sold on the Platform, LocaleKart offers no representations or warranties. LocaleKart disclaims all obligation for mistakes or omissions and does not recommend the purchase or sale of any goods or services on the Platform.
- Any non-performance or breaking of any agreement between Buyers and Sellers is not LocaleKart’s fault. It is not compelled to mediate or settle disputes, and it cannot guarantee that Buyers and/or Sellers will complete any transaction made on the Platform.
- LocaleKart does not acquire ownership of the goods or services provided by Sellers during any transaction, nor does it acquire any rights or claims thereto. Regarding the agreement made between Buyers and Sellers, LocaleKart has no rights, title, or interest in the products. Nor does it have any obligations or liabilities. Platform does not bear liability for services rendered in an unsatisfactory or delayed manner, nor for any delays or damages resulting from backordered, unavailable, or out-of-stock merchandise.
Refund and Shipping Policy for buyers:-

Order Processing:
Once you place an order with one of our partner stores through LocaleKart, the store will process and ship your order. The estimated delivery time and shipping charges will be provided at the time of purchase.
Shipping Confirmation:
You will receive a confirmation email with tracking information once your order has been shipped. Please note that the delivery times may vary depending on the location of the partner store and the delivery destination.
Delivery:
Our partner stores aim to deliver your order within the estimated time frame provided. However, delays may occur due to unforeseen circumstances. If your order is significantly delayed, please contact the store directly or reach out to our support team for assistance.
Shipping Charges:
Shipping charges, if applicable, will be displayed at checkout. These charges may vary based on the delivery location, the size, and the weight of the order.
- Refund Policy
Eligibility for Refunds:
Refunds are available for products purchased from our partner stores under the following conditions:
- The product is defective or damaged upon arrival.
- The product received is different from what was ordered.
- The product does not match the description provided by the partner store.
Return Process:
To initiate a return, please contact the partner store directly or through LocaleKart’s support within 2hr of receiving the product. The store will provide instructions for returning the item. The product must be returned in its original packaging, unused, and in the same condition as received.
Refund Method:
Once the returned product is received and inspected by the partner store, a refund will be processed. The refund will be credited to the original payment method within 7 days. Please note that shipping charges, if any, are non-refundable unless the return is due to a defect or error on the part of the store.
Non-Returnable Items:
Certain products may be marked as non-returnable at the time of purchase. These items are not eligible for refunds or exchanges unless they arrive damaged or defective.

User Conduct
Prohibited Activities:

Compliance with Laws:
You must comply with all local, state, national, and international laws while using our Services.
Consequences of Violations:
We reserve the right to suspend or terminate your access to our Services and take any necessary legal action if you violate these T&C.
Limitation of Liability
Disclaimer of Warranties:
Our Services are provided “as is” and “as available” without any warranties, express or implied. We do not guarantee that our Services will be uninterrupted, error-free, or free from viruses.
Limitation of Liability:
In no event shall LocaleKart be liable for any indirect, incidental, special, or consequential damages arising out of your use of our Services.
Indemnification:
You agree to indemnify and hold LocaleKart harmless from any claims, losses, or damages arising from your use of our Services or violation of these T&C.
Subscription Cancellation for Retailer:
You may cancel your subscription to our Services at any time through your account settings. Upon cancellation, you will continue to have access to the Services until the end of your current billing period.
Refunds:
Payments already made are non-refundable. However, we may offer future credits for use in our Services at our discretion.
Future Credits:
In cases where we offer credits for future purchases, these credits are non-transferable and must be used within a specified period.
Governing Law:
These T&C are governed by and construed in accordance with the laws of India.
